1. About monsterPB

monsterPB is a community-driven pickleball app that allows users to discover courts, check in, report court conditions (busyness, availability), and connect with other players. The app is operated by Heliotrope Development LLC.

2. Eligibility

You must be at least 13 years of age to use monsterPB. By using the app, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

3. Account Registration

You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information and to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

• Submit false, misleading, or inaccurate court conditions or venue information
• Harass, threaten, or harm other users
• Use the app for any unlawful purpose
• Attempt to access other users' accounts or private information
• Reverse engineer, decompile, or tamper with the app
• Use automated tools to scrape or spam the service
• Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these rules.

5. User-Generated Content

You retain ownership of content you submit (reports, check-ins, videos, profile info). By submitting content, you grant monsterPB a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content within the app, on our website, and through our social media and YouTube channels.

You are solely responsible for the accuracy of court reports and check-ins you submit. Court conditions change frequently — information in the app reflects community reports and may not be current.

6. Video Submissions & YouTube Publishing

monsterPB allows users to submit videos of pickleball courts, gameplay, and related content. By submitting a video, you acknowledge and agree that:

• You have the right to share the video and any individuals identifiable in the video were recorded in a public setting or with their knowledge
• Your video may be reviewed, edited, and published publicly on the monsterPB YouTube channel and other monsterPB platforms
• Once published, the video will be publicly viewable on YouTube and subject to YouTube's Terms of Service and Privacy Policy
• You may request removal of a video you submitted by contacting us at support@monsterpb.net
• We reserve the right to reject, remove, or edit any submitted video at our sole discretion

At the time of upload, you will be asked to confirm your agreement to these terms via an in-app consent checkbox. We log this consent (including your user ID, timestamp, and policy version) for compliance and audit purposes.

7. Intellectual Property

The monsterPB application, including its name, logo, design, source code, and all content created by Heliotrope Development LLC, is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the app on your personal device solely in accordance with these Terms. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from any part of the app without our prior written permission.

8. Subscriptions (monsterPB Plus)

monsterPB offers an optional Plus subscription that removes advertisements. Subscriptions are billed through the Google Play Store or Apple App Store. Prices are displayed at the time of purchase and may vary by region.

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel your subscription through your Google Play or Apple App Store account settings
• No refunds are provided for partial subscription periods, except as required by applicable law
• We reserve the right to change subscription pricing with reasonable notice

9. Free Tier and Advertising

The free version of monsterPB is supported by advertising provided by Google AdMob. By using the free tier, you consent to the display of advertisements. Upgrade to monsterPB Plus to use the app ad-free.

10. Monster Stars & Leaderboard

Monster Stars are awarded for community contributions (court reports, vouches). They have no monetary value and cannot be exchanged for cash or prizes. We may run optional monthly contributor recognition programs at our sole discretion, which may be modified or discontinued at any time.

11. Third-Party Services

monsterPB integrates with third-party services including Google AdMob, RevenueCat, Google Maps, Google Cloud, YouTube, and Resend. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, availability, or content of third-party services. Integration with or links to third-party services do not constitute an endorsement by us.

12. Disclaimer of Warranties

monsterPB is provided "as is" without warranties of any kind. We do not guarantee that court information is accurate, current, or complete. Court availability, hours, and conditions are reported by community members and may not reflect actual conditions. Always verify court availability independently before making a trip.

13. Limitation of Liability

To the maximum extent permitted by law, Heliotrope Development LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to inaccurate court information or service interruptions.

14. Termination

You may delete your account at any time from the app settings. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to use the app ceases and we may delete your data in accordance with our Privacy Policy.

15. Apple and Google Distribution Platforms

monsterPB is distributed through the Apple App Store and Google Play Store. These Terms are an agreement between you and Heliotrope Development LLC only — not with Apple Inc. or Google LLC. The following additional terms apply:

• Apple and Google have no obligation to provide maintenance or support for monsterPB
• Apple and Google are not responsible for any product claims, warranty, or liability related to monsterPB
• Apple and Google are not responsible for any third-party intellectual property infringement claims related to monsterPB
• You must comply with any applicable third-party terms when using monsterPB (e.g., your mobile carrier's data agreement)

Apple as Third-Party Beneficiary: Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the app after the effective date of changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
